Welcome to Itemify! These Terms of Use ("Terms") govern your use of the Itemify mobile application (the "App") and related services (the "Services"). By accessing or using the App, you agree to these Terms and our Privacy Policy. If you disagree, do not use the Services.
1. Eligibility & Use of Services
You must be at least 13 years old to use the Services. If you are under 18 years of age, you must have your parent or legal guardian’s permission to use this App, and your parent or legal guardian must agree to these Terms on your behalf.
Currently, Itemify does not require you to create a direct user account to use its core features. However, certain functionalities, such as cloud backup or synchronization with third-party services (e.g., iCloud, Google Drive), may require you to have an active account with those respective third-party providers. You are responsible for maintaining the security of any such third-party accounts used in conjunction with Itemify.
We reserve the right to introduce account registration requirements for Itemify in the future. If we do so, we will provide notice and update these Terms accordingly. Any such future account will require you to provide accurate information, and you will be responsible for maintaining the confidentiality and security of your Itemify account credentials.
2. License & Acceptable Use
We grant you a limited, non-exclusive, non-transferable license to use Itemify for personal or internal business purposes, in accordance with these Terms.
You agree NOT to:
- Use Itemify for illegal activities or in violation of any applicable laws.
- Infringe upon the rights of third parties, including intellectual property rights (e.g., copyrights, trademarks).
- Attempt to reverse-engineer, decompile, hack, disable, interfere with, or otherwise disrupt the integrity or performance of the App.
- Upload or transmit malware, viruses, or any other malicious code.
- Engage in any fraudulent activity or misrepresent your identity or intentions.
3. User Content & Data
- You retain full ownership of all data, information, and materials you input or upload into Itemify ("User Content").
- By using Itemify, you grant us a limited, worldwide, royalty-free license to access, use, reproduce, and process your User Content solely for the purpose of providing and improving the Services to you.
- We are committed to protecting your privacy. We do not sell your personal User Content to third parties. Please review our Privacy Policy for detailed information on how we collect, use, and protect your data.
4. Pro Subscription Terms (If Applicable)
Premium Features & Subscriptions
If Itemify offers premium features through a subscription ("Pro Subscription"), the following terms apply:
- Subscription Period: Subscriptions are typically offered on a monthly or annual basis, as selected at the time of purchase.
- Auto-renewal: Pro Subscriptions will automatically renew for the same duration unless you cancel your subscription at least 24 hours before the end of the current subscription period through your App Store account settings.
- Payment: Payment will be charged to your App Store (e.g., Apple App Store, Google Play Store) account upon confirmation of purchase and at the beginning of each renewal period.
- Cancellation: You can manage and cancel your subscriptions by going to your account settings in the respective App Store after purchase.
- Refunds: Except when required by law, paid subscription fees are non-refundable. No refunds or credits will be provided for partially used periods.
- Price Changes: We reserve the right to modify subscription fees. Any price changes will apply to subsequent renewal periods after providing you with reasonable notice (e.g., via email or an in-app notification), typically at least 30 days.

5. Third-Party Services & Integrations
Itemify may allow you to integrate or use its features in conjunction with third-party services, such as iCloud, Google Drive, or other cloud storage providers and data services (e.g., WebDataRocks for reporting features). Your use of any such third-party services is subject to their respective terms of use and privacy policies. Itemify is not responsible for the functionality, availability, security, or practices of these third-party services, nor for any data loss or issues arising from their use. You acknowledge that you use such third-party services at your own risk.
By using Itemify’s reporting features, you agree to be bound by the WebDataRocks EULA (https://www.webdatarocks.com/license-agreement/) , which applies to reporting features, and confirm you have read and understood the terms and conditions of the EULA and meet its conditions (clause 1.2)
6. Disclaimers of Warranties
THE APP AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE:
- Uninterrupted, timely, secure, or error-free.
- Accurate, reliable, complete, or current. This includes any inventory predictions, analytics, or calculations performed by the App.
You acknowledge that your use of the Services is at your sole risk.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ITEMIFY, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages.
- Damages for lost profits, revenue, data, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
8. Changes to Terms & Termination
- We reserve the right to modify or update these Terms at any time. We will provide reasonable notice of material changes (e.g., by posting a notice within the App or sending an email to registered users, if applicable).
- Your continued use of the Services after such changes become effective constitutes your acceptance of the new Terms.
- We may, in our sole discretion, suspend or terminate your access to all or part of the Services at any time, with or without notice, for any reason, including, without limitation, for breach of these Terms.
9. Governing Law & Dispute Resolution
This Terms of Use Agreement shall be governed by and construed under the laws of the United States of America, without regard to its conflict of law provisions.
